Terms and conditions

The terms for using the Evenbuilt website and for the audit, automation and software development services we provide.

These terms apply when you use evenbuilt.com and when you engage Evenbuilt for services. By using the site or accepting a quote you agree to them. If a signed proposal, statement of work or other written agreement for your project says something different, that document wins for that project.

Using this website

  • The articles, calculators and tools on this site are general information. Figures from the playground tools are estimates based on what you enter, not quotes or professional advice.
  • You may not use the site to send spam, attempt to break its security, or scrape it in a way that disrupts it.
  • The site's design, copy and code belong to Evenbuilt. You are welcome to link to and quote it with attribution. Third-party names and logos belong to their owners, and listing a tool does not imply a partnership.
  • We aim to keep the site accurate and available but do not guarantee it will always be either.

Quotes and scope

  • Every project is quoted in writing as a fixed price for a defined scope. Nothing is chargeable until you accept a quote.
  • Quotes are valid for 30 days unless they say otherwise.
  • Changes to the agreed scope are quoted separately and only go ahead once you approve them in writing.
  • Timelines depend on you providing access, information and feedback when needed. Delays on either side move the schedule, and we will tell you promptly if a date is at risk.

Payment

  • Audits are invoiced in full before work starts.
  • Build projects are invoiced in milestones set out in the quote, usually with a deposit before work begins.
  • Invoices are due within 14 days. We may pause work on an overdue account after giving you written notice.
  • Prices are in US dollars and exclude taxes and any third-party costs (hosting, software licences, paid APIs), which you pay directly or which are passed on at cost with your approval.
  • Refunds are covered by our refund policy.

Your responsibilities

  • Give us the access, accounts and information the project needs, and make sure you have the right to share them.
  • Review and respond to deliverables within a reasonable time.
  • Keep your own backups of business-critical data before changes are made to live systems.
  • Make sure your use of what we build complies with the laws and third-party terms that apply to your business.

Ownership

  • Once the relevant invoices are paid in full, you own the custom code, designs and documentation we create for you, along with the accounts and data we set up in your name.
  • We keep ownership of general tools, libraries and know-how we developed before or outside your project, and grant you a permanent, royalty-free licence to use any of it included in your deliverables.
  • Open-source and third-party components remain under their own licences.
  • Unless you ask us not to, we may describe the project in general terms in our portfolio without disclosing confidential information.

Confidentiality

We keep your business information, data and credentials confidential, use them only to do the work, and remove our access when the project or support ends. We are happy to sign a mutual NDA before the first detailed conversation.

Warranty and support

  • We carry out the work with reasonable skill and care, to the scope agreed in writing.
  • Defects in what we built that you report within 30 days of launch are fixed at no charge.
  • After that, fixes and changes are covered by optional monthly support or quoted separately.
  • We are not responsible for problems caused by changes made by others, or by outages, price changes or API changes in third-party services outside our control.

Limitation of liability

To the extent the law allows, Evenbuilt's total liability for any project is limited to the fees you paid for that project in the 12 months before the claim, and neither party is liable for indirect or consequential losses such as lost profits or lost data. Nothing in these terms limits liability that cannot be limited by law.

Ending a project

Either party can end a project with written notice. You pay for work completed up to that point, receive everything produced so far that you have paid for, and any prepaid amount for work not done is refunded as set out in the refund policy.

General

  • These terms are governed by the laws of the State of California. Disputes will be handled in the courts of Los Angeles County, after both parties have first tried in good faith to resolve them directly.
  • Neither party is responsible for delays caused by events outside their reasonable control.
  • If part of these terms is found unenforceable, the rest still applies.
  • We may update these terms. The version in effect when you accepted a quote applies to that project.
